Trademark Litigation The Issue: A Florida-based entertainment business was sued for using a name similar to a competing business. The competitor wanted David’s client to change its name and to pay significant damages. The Result: After David presented weaknesses in the competitive business’s case, he settled the dispute and no penalty was paid. Copyright Litigation The Issue: A large publishing company accused a New York client of copyright infringement. The Result: Using procedural grounds, David defended the client and the lawsuit was dismissed. Patent Litigation The Issue: The owner of electronic equipment hardware patents planned to file an infringement claim against David’s client, a hardware importer. The Result: By pointing out infirmities in the patent, the firm persuaded the owner not to file any claim. Other Types of Litigation Fraud: David obtained a $360,000 judgment, including $270,000 in punitive damages, for fraud based on a promissory note. Class Action: David successfully represented a group of class-action plaintiffs against a major foreign auto manufacturer. Business Dispute: David successfully tried a case involving the breach of a fiber optic cable contract, resulting in a substantial verdict in his client’s favor. Employment Dispute: David obtained a $3.6 million judgment for a client in an employment discrimination, breach of contract and defamation case. |
